You agree, in consideration for the privilege of using an Online Services account, to the following terms and conditions, as may be revised from time to time without notice.

All use of any Online Services account shall be subject to the following conditions and restrictions on Online Services liability. These Conditions of Use of Online Services accounts are independent of, in addition to, and not in limitation of any agreement or contract established between Online Services and any user of an Online Services account.

The use of, and access to, an Online Services account is a privilege which may be revoked at any time, in the exclusive and unlimited discretion of (by) the administrators of the system (at any time) for abusive conduct. Such conduct (would) includes, but is not (be) limited to, the placing of unlawful information on the system; the use of obscene, abusive or otherwise objectionable terms, displays or language in either public messages or (upon registration of complaints about) private messages; the sending of unsolicited email, also known as spam. The services provided by Online Services are established pursuant to, and exclusively for the purposes stated in, ORS 354.505 to 354.550, and does not constitute a public forum for uncontrolled expression. The staff of Online Services will be the sole arbiter of what constitutes obscene, abusive or objectionable language, and spam.

1. Online Services Control of Content
   No user has the right to rely on the confidentiality, or the preservation of the confidentiality, of any material the user places on the Online Services systems. Online Services reserves the right to review any material stored in files to which all users have access, and will edit or remove any material, with no liability on the part of Online Services for such editing or removal, which the staff, in its sole discretion, believes may be unlawful, obscene, abusive or otherwise objectionable.
2. User Responsibility for Abuse of Intellectual Property Rights
   No person shall use an Online Services account, without previously obtaining the express written consent from the holder of such rights, to enter, send, broadcast or otherwise communicate information, data or material in which another person or entity has patent, copyright or other proprietary interest. The user shall be exclusively responsible for the content of any message the user places on the Online Services systems, and shall indemnify, defend, and hold the State of Oregon, Online Services, their officers and employees harmless from any claim, demand, copyright infringement, appropriation of proprietary rights, invasion of privacy, and defamation.
3. No Online Services Warranties
   Online Services makes no warranty or representations, and expressly DISCLAIMS ALL WARRANTIES concerning the operation, maintenance or performance of Online Services systems, including but not limited to warranties of merchantability or of fitness for a particular purpose of an Online Services account or any component thereof. No refunds.
4. Online Services Not Responsible for Damage, Losses, Etc.
   The user shall assume all risk associated with or arising out of the user's use of or access to an Online Services account, including but not limited to: (a) any damage to, or destruction, loss, alteration or impairment of, the user's hardware or software; (b) any damage to, or destruction, loss, alteration or impairment of, any material, data, message or information transmitted, received or accessed by the user; and (c) any result or consequence of the user's transmission, receipt or accessing of any material, data, message or information while using an Online Services account or any component thereof.
5. Account Owner Functions
   As the account owner, you agree to review the above terms and conditions with anyone who has access to any Online Services account for which you are responsible.
